Is Kalshi Gambling? What the Courts Have Ruled

Whether Kalshi is gambling depends on which court you ask. In April 2026 the Third Circuit said its sports contracts are likely swaps, which federal law leaves to the CFTC alone; in August 2026 the Ninth Circuit said they are likely sports bets, which lets Nevada enforce its gambling law against them. The Supreme Court has been asked to settle it. How your trades are taxed is a separate question the IRS hasn't answered.

Is Kalshi gambling or trading?

Legally, it has been called both, by different parts of the government.

To federal law, Kalshi is an exchange. The Commodity Futures Trading Commission designated it a contract market in November 2020, as both federal appeals courts note (Third Circuit opinion, p.2), and the CFTC treats its event contracts as derivatives inside its jurisdiction. The agency has backed that position in court: it filed a brief supporting Kalshi in Massachusetts' highest court, and when a Michigan court ordered Kalshi to cancel trades it stepped in to order them honored, saying "A state cannot force a DCM to violate its obligations."

To state gaming regulators, Kalshi's sports contracts are sports betting. Nevada's regulator told Kalshi in March 2025 that its sports and election contracts are "unlawful in Nevada, unless and until approved as licensed gaming". Massachusetts' attorney general sued Kalshi for offering sports wagering without a state license, and Michigan's gaming regulator told the CFTC that buying one is "materially identical to an internet sports betting wager" under state law.

Which label controls is a question about jurisdiction: whether federal commodities law keeps state gambling law off an exchange the CFTC regulates. That is the question the federal appeals courts have split on.

Because Kalshi's footing is federal. It argues that the Commodity Exchange Act gives the CFTC exclusive jurisdiction over contracts traded on an exchange like Kalshi's, which leaves no room for state gambling law. The CFTC agrees, and has sued nine states to protect that jurisdiction.

It is an argument, not a settled rule. Where a court has rejected it and ordered a block, Kalshi has had to switch those markets off for anyone in the state, and in each of those states some of its other markets still trade. What did the Third and Ninth Circuits decide?

The split is over one word. Federal law gives the CFTC exclusive jurisdiction over "swaps" traded on an exchange like Kalshi's. If a sports contract is a swap, state gambling law can't reach it. If it isn't, the state can.

Both rulings came at the preliminary-injunction stage. The Third Circuit found Kalshi likely to succeed in showing that federal law preempts New Jersey's, over a dissent by Judge Roth, who wrote that Kalshi's sports offerings are "virtually indistinguishable from the betting products available on online sportsbooks" (dissent, PDF p.21). The Ninth Circuit found Kalshi hadn't shown it was likely to succeed, and sent the question of election contracts back to the district court. It decided Crypto.com's and Robinhood's appeals the same day.

Neither is the last word. Kalshi has asked the full Ninth Circuit to rehear its case, and the Fourth, Sixth, Tenth and Second Circuits have appeals of their own pending. What have state courts found?

State courts have gone a step further and ordered Kalshi's sports contracts blocked. Each of these is a preliminary injunction, granted while the case goes on:

  • Washington. On July 20, 2026 a King County Superior Court judge found that "The State has shown a likelihood that Kalshi's conduct violates multiple provisions of the Washington Gambling Act," and concluded that "The Commodity Exchange Act (CEA) does not preempt Washington State gambling law" (order, p.11 and p.6).
  • Nevada. A Carson City court granted the state's gaming regulators a preliminary injunction on April 3, 2026. A federal judge in Nevada had already dissolved Kalshi's own injunction against the state in November 2025, the ruling the Ninth Circuit later upheld.
  • Michigan. An Ingham County judge signed a preliminary injunction on September 1, 2026, barring Kalshi from offering internet sports betting and similar products to anyone in Michigan.
  • Massachusetts. A Suffolk Superior Court judge granted the state a preliminary injunction on January 20, 2026. It is paused while the state's Supreme Judicial Court decides the appeal.

Federal trial courts are divided too. A federal judge in Utah gave the state summary judgment on August 4, 2026, the first final ruling on the merits. Others have ruled against the states: a federal judge in Tennessee enjoined the state for Kalshi in February, and in cases the CFTC joined or brought, federal judges preliminarily enjoined Arizona's criminal prosecution in May (KalshiEX v. Johnson, D. Ariz. No. CV-26-01715, into which the CFTC's case was consolidated) and paused Minnesota's ban in July. Where each of these stands now is on the state-by-state page.

Does the IRS treat Kalshi as gambling?

The IRS hasn't said, either way. A court finding that Kalshi likely breaks state gambling law isn't a ruling on how your trades are taxed, and neither circuit's answer is a tax holding. Federal tax treatment is a question under the Internal Revenue Code, and no court or IRS guidance has settled it for event contracts.

One connection is worth knowing. "Swap" is also a word in the tax code's exclusion from section 1256 treatment, so the Supreme Court's answer could matter to that tax argument indirectly.
