Is Kalshi Legal in My State? Every State's Status

As of September 2026, no state has switched Kalshi off entirely, but courts have switched off some of its markets in three: Washington State, Nevada and Michigan. A Massachusetts court ordered its sports contracts off too, then paused the order, so you can still trade there. In a further 15 states, a lawsuit, ruling or cease-and-desist is live, but nothing is switched off yet. Every status below links its source.
Is Kalshi legal in all 50 states?
No state has switched Kalshi off entirely. Where a state court's order is in force, Kalshi has to block some kinds of market, sports among them, for anyone located in that state, and its other markets keep trading. The map shows which in each state.
It sorts every state into four groups:
- Switched off: a court order is in force, and Kalshi has to block those markets for anyone in the state.
- Ordered, on hold: a court ordered a block, then paused it during the appeal. You can still trade there today.
- Being fought: a lawsuit, ruling or cease-and-desist is live, but nothing is switched off yet.
- No action found: we found no order, lawsuit or cease-and-desist against Kalshi there.
Behind all of it is one open question: whether federal commodities law keeps state gambling law away from contracts on a federally registered exchange. Two federal appeals courts have answered it in opposite ways, and three petitions now ask the Supreme Court to decide.

Which states have banned Kalshi?
No state has banned Kalshi outright. Courts have switched off some of its markets in three states: Washington State, Nevada and Michigan. In Massachusetts, a court ordered a block that is on hold. In 15 more states, a case or order against Kalshi is live, but nothing is switched off.
Is Kalshi legal in Michigan?
Kalshi is switched off in Michigan for 1 of 12 market categories, since Jun 29, 2026.
Sports contracts are switched off. The order names no other category.
- Withdraw your cash: not addressed. The order doesn't mention withdrawals. Primary source
- Close open positions: not addressed. The order bars Kalshi from settling sports contracts for anyone in Michigan, and doesn't say whether you can exit. The federal regulator separately ordered trades to be honoured in the normal way, so this is unresolved. Primary source
- New trades: blocked. No sports trades for anyone located in Michigan, enforced with a Michigan-licensed geolocation vendor. Primary source

Ingham County Circuit Court (Judge Rosemarie Aquilina) signed a preliminary injunction on September 1. It covers sports betting and similar products only, and requires a Michigan-licensed geolocation vendor, with a $500,000 fine for each day geolocation is found non-compliant.

Is Kalshi legal in Nevada?
Kalshi is switched off in Nevada for 3 of 12 market categories, since Mar 20, 2026.
Sports, election and entertainment contracts are switched off.

Off in Nevada: Sports, Elections, Entertainment.
Carson City District Court granted Nevada a preliminary injunction on April 3. On August 28 the Ninth Circuit ruled 3-0 against Kalshi on the federal question. Nevada regulators have alleged that the geofence leaked and are asking for $120,000 a day.
What’s next in Nevada: Kalshi has asked the full Ninth Circuit to rehear the case. The state-court injunction stays in force either way.

Is Kalshi legal in Washington State?
Kalshi is switched off in Washington for 7 of 12 market categories, since Sep 2, 2026.
Seven of Kalshi's twelve categories are switched off, sports and elections among them. The order lets finance, economics, climate and commodities keep trading, and doesn't say whether crypto is covered.

King County Superior Court (Judge John McHale) granted a preliminary injunction on July 20 and signed the amended order on August 12. Kalshi had to geofence by IP and residency by August 19 and through GeoComply by September 2. The order says Kalshi will not stop users exiting positions they already hold, and does not stop Washington users closing their accounts and withdrawing funds. The Court of Appeals refused to pause it, and on September 16 the judge refused to reconsider.

Is Kalshi legal in Massachusetts?
A court ordered Kalshi to block markets in Massachusetts, but the order is on hold, so you can still trade there.
A court ordered sports contracts off, then paused it. You can still trade here.
Suffolk Superior Court granted Massachusetts a preliminary injunction on January 20. An Appeals Court justice stayed it in February pending appeal. The Supreme Judicial Court heard the case on May 4, hasn't ruled, and has waived its usual 130-day deadline for deciding.

Is Kalshi legal in Arizona?
A case or order against Kalshi is live in Arizona, but nothing is switched off there yet.
Arizona's criminal case against Kalshi is blocked for now. Nothing is switched off.
Arizona filed 20 misdemeanor counts in March. On May 5 a federal judge granted the CFTC a preliminary injunction blocking the prosecution while the case goes on. After the Ninth Circuit's August ruling, Arizona can ask to lift that block.

Montana's gambling regulator sent a cease-and-desist in April. In September the two sides agreed to dismiss Kalshi's suit with the regulator barred from enforcing, while the attorney general stays free to act later.

What states have sued Kalshi?
The cases against Kalshi come in three kinds, and only the first has switched anything off.
- A state takes Kalshi to court. Washington's attorney general sued in King County Superior Court on March 27, 2026, Michigan's in Ingham County Circuit Court on March 3, 2026, and Massachusetts' in Suffolk Superior Court on September 12, 2025. Nevada's gaming regulators went to court in Carson City. New York, Connecticut, Kentucky and Wisconsin have sued too, and Arizona filed criminal charges. Every order that has switched Kalshi markets off came out of a case like these.
- Kalshi sues the state first, asking a federal court to stop regulators enforcing state gambling law against it. It did this in Nevada in March 2025, after the state's gaming regulator told it to stop.
- A regulator sends a cease-and-desist letter, as Montana and Missouri have. A letter on its own switches nothing off.

Is Kalshi gambling?
Two federal appeals courts answered that in opposite ways in 2026. On April 6 the Third Circuit ruled for Kalshi, holding that its sports contracts are likely swaps that only the federal regulator can police. On August 28 the Ninth Circuit held that they are likely sports bets, which lets Nevada enforce its gaming law against them. Can I get my money out of Kalshi if my state blocks it?
A state block stops new trades in the markets it covers. The rules that hold your cash are set by Kalshi's clearinghouse, Kalshi Klear, which has been registered with the CFTC since August 2024, and they don't change from state to state:
- Withdrawals. Klear's rulebook says they occur "no later than the next Settlement Bank Business Day after a Member has submitted a withdrawal request" (R6.4C). It makes no exception for state restrictions.
- Your deposits are kept apart. Money you deposit directly "shall be segregated from all other funds held by the Company and treated as belonging to Members" (R7.7F, R7.9C).
- What isn't insured. SIPC doesn't cover these accounts: "SIPC does not protect commodity futures contracts." Klear sweeps cash to banks for FDIC coverage, but its member agreement says "FDIC insurance is not guaranteed to you" (§IV).
What each state's order adds differs. Washington's says in terms that nothing in it stops you closing your account and withdrawing your funds, or exiting positions you already hold (amended order, pp.13-14). Michigan's order doesn't mention withdrawals, and we haven't yet verified what Nevada's written order says on the point. Each state's entry above has the line and its source.

Why does Kalshi say my location is restricted?
Because the orders make the block follow where you are, not only where you live. Washington's order had Kalshi block by IP address and residency from August 19, 2026, then through GeoComply from September 2, to stop "anyone located within the geographic boundaries of the State of Washington" buying the covered contracts (amended order, p.13). Michigan's order requires a geolocation provider licensed by the state's gaming control board. And in Nevada, Kalshi agreed in July to a geofence that stops "anyone within the geographic boundaries of the State of Nevada" from entering the blocked contracts.
So a location check that stops you in one of those states may be doing what the order requires, and it can stop you trading sports while leaving other markets open.

Is Kalshi legal in all 50 states?

Several states' attorneys general or gaming regulators have taken Kalshi to court, among them Washington, Michigan, Massachusetts and Nevada. In other states Kalshi sued first, asking a federal court to stop regulators enforcing state gambling law against it, and some states have sent cease-and-desist letters. A lawsuit on its own switches nothing off; only a court order in force does.
Can I withdraw my money from Kalshi if my state blocks it?
Kalshi Klear's rulebook says withdrawals happen no later than the next settlement bank business day after you ask, and it makes no exception for state restrictions. Washington's court order says expressly that it doesn't stop you closing your account and withdrawing your funds. SIPC doesn't cover prediction-market accounts, and Kalshi Klear's own agreement says FDIC coverage of its bank sweep is not guaranteed to you.
Is Kalshi gambling?
Federal appeals courts disagree. In April 2026 the Third Circuit ruled for Kalshi, holding that its sports contracts are likely swaps under federal commodities law, and in August 2026 the Ninth Circuit held that they are likely sports bets that Nevada can regulate. Neither ruling decides how your trades are taxed.
