Is Kalshi Legal in Washington State? What's Off

Since September 2, 2026, a King County Superior Court order has required Kalshi to block sports, elections and five other kinds of market for anyone in Washington State. Its finance, economics, climate and commodities markets are still available. Kalshi isn't banned outright: the order is a preliminary injunction, and it lets you exit positions you already hold and withdraw your money.

Why did a Washington court block Kalshi?

Washington's attorney general sued Kalshi on March 27, 2026 in King County Superior Court, under the state Gambling Act and Consumer Protection Act. Kalshi moved the case to federal court the same day. A federal judge sent it back on May 5, and the Ninth Circuit refused to pause that on May 21 (docket).

On July 20, Judge John McHale granted the state a preliminary injunction. He concluded that "The Commodity Exchange Act (CEA) does not preempt Washington State gambling law" (p.6, l.14), and found that "The State has shown a likelihood that Kalshi's conduct violates multiple provisions of the Washington Gambling Act" (p.11, ll.17-18). Those are findings made to decide whether Kalshi should be blocked while the case goes on. They aren't a final judgment, and the main case is still open.

Federal appeals courts have split on the same preemption question. On April 6, 2026 the Third Circuit ruled for Kalshi against New Jersey, holding that federal commodities law likely preempts state gambling law for its sports contracts. On August 28 the Ninth Circuit, the circuit that covers Washington, ruled for Nevada, holding that sports contracts likely aren't swaps and that federal law likely doesn't preempt Nevada's gaming law. Three petitions now ask the Supreme Court to settle it: Kalshi at the Supreme Court follows them, and is Kalshi gambling? sets out both sides. None of these rulings, the Washington order included, decides how your trades are taxed.

Why does Kalshi say my location is restricted in Washington State?

The order sets the test Kalshi has to apply. By August 19 it had to block by IP address and by residency, and by September 2 through GeoComply, a multi-source location check "designed to prevent anyone located within the geographic boundaries of the State of Washington from purchasing any event contract" in the covered markets (amended order, p.13, ll.14-19).

So the test is where you are, not only where you live: if you are physically in Washington, the seven switched-off categories stay off whatever address your account lists, and residency is a second test the order names. Finance, economics, climate and commodities are outside the order. Crypto is one of Kalshi's tabs the order describes (p.2, ll.21-22), but it is in neither the banned list nor the carve-out, so the order doesn't settle it either way.

Does the Washington order cover Crypto.com, Robinhood and other apps?

The order's operative terms name Kalshi, and they say nothing about Kalshi contracts bought through a broker (amended order, pp.13-14). Other companies offering event contracts in Washington are in cases of their own, and as of September 22, 2026 each stands differently:

Crypto.com's exchange, OG (North American Derivatives Exchange): on August 18 the state agreed not to bring enforcement actions against OG's event contracts while related Ninth Circuit appeals are pending, and a federal judge signed that as an order on August 27 (docket).
Robinhood Derivatives sued Washington officials in federal court on March 30 to stop the state enforcing its gambling law against it (docket). On May 21 the state agreed not to bring enforcement actions against "Robinhood's role in transactions involving event contracts traded on a DCM" (a federally registered exchange) until the Ninth Circuit decides the Nevada appeals, and the judge stayed the case (order, p.3, ll.1-8).
Ludlow Exchange, a Novig affiliate, sued Washington officials on August 6 on the same ground (docket).

Kalshi pointed to the OG agreement when it asked Judge McHale to reconsider around August 20 (crypto.news). He refused in mid-September, and the injunction stands (Law360, September 18, 2026; PM Pulse).

King County Superior Court (Judge John McHale) granted a preliminary injunction on July 20 and signed the amended order on August 12. Kalshi had to geofence by IP and residency by August 19 and through GeoComply by September 2. The order says Kalshi will not stop users exiting positions they already hold, and does not stop Washington users closing their accounts and withdrawing funds. The Court of Appeals refused to pause it, and on September 16 the judge refused to reconsider.

What’s next: Kalshi can still ask a full Court of Appeals panel or the Washington Supreme Court to step in, and the main case continues.

Is Kalshi still available in Washington State?

Partly. As of September 22, 2026, Kalshi's finance, economics, climate and commodities markets are still available in Washington State. A King County Superior Court preliminary injunction requires Kalshi to block its sports, elections, politics, entertainment, culture, tech and science, and mentions markets for anyone located in the state, with a final geofencing deadline of September 2, 2026.

Can I withdraw my money from Kalshi in Washington?

Yes. The amended order of August 12, 2026 says: "Nothing in the Order shall prohibit Kalshi from allowing Washington, identified or self-reported consumers to close or deactivate their Kalshi accounts and withdraw funds." It also says Kalshi will not prohibit users from exiting positions they already hold. It says nothing about deposits.

Why is Kalshi banned in Washington?

It isn't banned outright: 7 of Kalshi's 12 market categories are switched off. In a July 20, 2026 preliminary injunction, Judge John McHale of King County Superior Court found that Washington had shown a likelihood that Kalshi's conduct violates the state Gambling Act, and concluded that the federal Commodity Exchange Act does not preempt state gambling law. Those findings are preliminary, and the main case continues.

What happens to the money Washington users lost on Kalshi?

Nothing has been ordered. Washington's lawsuit asks the court to recover money Washington users lost, and the August 12, 2026 amended order reserves the state's right to seek the fees and losses Washington users incurred on or after September 2, 2026.

Will Kalshi come back in Washington?

Only if a court lifts or pauses the order. As of September 22, 2026, Kalshi can still ask a full Court of Appeals panel or the Washington Supreme Court to review the injunction; a win there could bring the markets back while the case continues. If Kalshi wins the main case in King County Superior Court, the block ends.

Does the Washington ruling change how Kalshi trades are taxed?
