Is Coinbase legal in Kentucky?

Last checked against court dockets and filings · Updated

As of October 26, 2026, we found no court order that stops Coinbase making event contracts available in Kentucky. The attorney general's June 17 suit says the sports contracts on Coinbase's Kalshi-sourced hub are unlicensed sports wagering. Kalshi's companies, in a brief Coinbase joined, call them federally regulated derivatives on a CFTC-regulated exchange. Neither position is a ruling on how your trades are taxed.

The suit

Why is Kentucky suing Coinbase?

Attorney General Russell Coleman filed the complaint in Franklin Circuit Court, dated June 17, 2026. It became No. 26-CI-00689 there (notice of removal, p.1). Coinbase Financial Markets, Inc. is the last of nine defendants, after five Kalshi companies, two Robinhood companies and Webull (complaint p.1).

The state's starting point is that Kentucky legalized online sports betting in 2023 under a licensing framework, and that the defendants "are not licensed to offer online sports wagering in Kentucky" (¶¶2-3, p.2). In its account, Coinbase partnered with Kalshi in December 2025 to launch a prediction markets hub that is "practically identical" to Kalshi's own site because its contracts are "sourced by Kalshi", and "Coinbase and Kalshi each receive a fee whenever an event contract is purchased" there (¶65, pp.16-17). It also alleges that Coinbase offers no self-exclusion option or problem gambling resources (¶117, p.34).

The counts

What are the four counts against Coinbase?

The complaint asserts Counts 13 to 16 against Coinbase Financial Markets alone (pp.50-54):

  • Count 13, deception, Kentucky Consumer Protection Act. The state alleges that Coinbase "has repeatedly conveyed the false, deceptive, and misleading impression that the sports wagers that it offers through its prediction market hub are lawful, and not void, in Kentucky" (¶216, p.50).
  • Count 14, unfair practices, same Act. It calls Coinbase's solicitation of sports wagers from people in Kentucky "unconscionable" and says it caused "substantial consumer injury in the form of monetary losses" (¶¶223-224, p.51).
  • Count 15, Loss Recovery Act. It says each sports wager by people in Kentucky on Coinbase's hub, and each transfer of money with it, "is void" (¶231, p.52). It treats Coinbase as a "winner" on those wagers because it took a fee on each, and asks for treble the money lost (¶¶235-236, p.53).
  • Count 16, gambling devices, KRS 528.100. It calls Coinbase's website and mobile apps gambling devices and asks for an order stopping them and $25,000 for each device (¶¶241-243, p.54).

The consumer counts each claim up to $2,000 for every willful violation, or $10,000 where the conduct was aimed at someone 60 or older (¶¶219, 228). The demand for relief, which covers all nine defendants, adds restitution or disgorgement, damages, and temporary and permanent injunctions (pp.55-56). Every characterization here is Kentucky's, and no court has ruled on any count.

Federal court

Why is Coinbase's Kentucky case in federal court?

Kalshi's five companies moved it there on June 19, 2026. Their notice of removal took the case to the Eastern District of Kentucky as No. 3:26-cv-00048 under 28 U.S.C. §§ 1331, 1441 and 1442, and it records that Robinhood and Coinbase "consent to removal" (ECF 1, p.1). Judge Robert E. Wier is assigned.

Kentucky moved to send it back on July 20, saying "Subject matter jurisdiction does not exist," and asked for its costs and fees (ECF 29, p.1). Kalshi's companies opposed on August 10, arguing that the state claims raise a substantial federal question and that removal is also proper under the federal officer statute (ECF 35, pp.1-4). A footnote says "Coinbase Financial Markets, Inc. joins in this Opposition" (p.1 n.1). The same brief describes Coinbase Financial Markets as a CFTC-registered futures commission merchant that partnered with KalshiEX "to make its event contracts available" through its platform (p.6).

Kentucky's reply, dated August 31, says the companies' federal question rests on "its anticipated defense" of preemption, and that "a preemption defense cannot support removal" (p.1). We could not read the court's docket for this check, so we could not determine whether Judge Wier has ruled.

HB 757

What is Kentucky's tax on prediction market operators?

Kentucky has also legislated about the businesses that run these markets. Section 71 of House Bill 757 (2026) sets out the measure:

  • Who. A "prediction market operator", defined as "a board of trade or other person, including any affiliate of the person, that operates a prediction market", including a person that owns, operates or controls a digital distribution platform, online portal or application store where a prediction market may be accessed (Sec. 71(1)(f), p.238).
  • Base and rate. 14.25% of the operator's transaction fees, meaning the fee it charges to complete a trade of an event contract and the amount a consumer pays to buy one from it (Sec. 71(1)(h) and (2), p.239).
  • Timing. "On and after January 1, 2027", due monthly by the 20th of the following month (Sec. 71(2)-(3), p.239); Section 136 makes Section 71 effective January 1, 2027 (p.386).
  • Status. The General Assembly's bill text is marked "Vetoed in Part and Overridden".

The section also says "It is not the intent of the General Assembly to legalize these activities" (Sec. 71(7), p.239). The statute names no company, and we found no Kentucky statement on whether Coinbase Financial Markets is an operator under it. The tax falls on operators' fees, not on a trader's gains or losses, and it does not decide the attorney general's suit.

Your account

Can Kentucky customers still use Coinbase's prediction markets?

No order we found in the Kentucky case reaches Coinbase customers, and nothing we read addresses accounts, deposits, withdrawals or open positions. The complaint alleges that Coinbase "makes sports wagering available to residents" of Kentucky (¶21, p.6), but that is the state's allegation, and we could not confirm from a primary document which contract categories Coinbase offers Kentucky residents today.

Two of the state's requests would reach customers' trades if a court granted them: the Loss Recovery Act count's claim that each Kentucky sports wager on the hub is void, and the requests for restitution. Both are requests in a case where, in the documents we read, nothing has been decided.

Other cases

How do other cases bear on Coinbase in Kentucky?

Kentucky's federal courts sit in the Sixth Circuit. On September 25, 2026, in Kalshi's Ohio and Tennessee appeals, that court held Kalshi "has not shown that its sports-event contracts satisfy the statutory definition of a 'swap'", and in the alternative that federal law "neither expressly nor impliedly preempts" those states' gambling laws (opinion, p.3). It is a preliminary-injunction ruling in cases Coinbase is not part of.

In Kentucky's separate suit against Polymarket's companies, No. 3:26-cv-00047, a magistrate judge recommended on October 14 that the case go back to state court (report, p.13). That is a recommendation in a different case before a different judge, and it does not decide Coinbase's. Polymarket in Kentucky follows it.

Kalshi's companies point the other way: their brief says "the CFTC has sued Kentucky itself", seeking a declaration that Kentucky's gambling laws are preempted as applied to CFTC-regulated exchanges (ECF 35, p.3), in United States v. Kentucky, No. 26-cv-49 (p.3 n.2). We did not read that docket for this page. Coinbase has made its own preemption case in suits it brought elsewhere: federal courts denied it preliminary injunctions in Michigan and Connecticut in August 2026, and the Illinois court granted its motion in part on October 2.

What happens next in Coinbase's Kentucky case?

Judge Wier decides whether the case stays in federal court or returns to Franklin Circuit Court. If it returns, the four counts would be argued there under Kentucky law; if it stays, the defendants' federal arguments would be heard in federal court. We found no answer or motion to dismiss from Coinbase in the documents we read. Kalshi in Kentucky and Robinhood in Kentucky cover the same case for its co-defendants, and every other state is on the Coinbase legal page.

Tax

Does the Kentucky case change how Coinbase trades are taxed?

Kentucky's suit and HB 757 are about who may license, regulate and tax the business, and a state gambling ruling is not a ruling on federal income tax. How the people we've seen file report a Coinbase event contracts year is in Coinbase prediction market taxes.

Your Kentucky return

Kentucky taxes personal income, at a flat 4% for 2025. Kentucky allows gambling losses as an itemized deduction, up to your winnings. Where you can trade follows where you are; Kentucky income tax follows its own residency rules.

Questions6 questions

Questions about Coinbase in Kentucky.

Short answers, as of Oct 21, 2026.

Is Coinbase legal in Kentucky?

As of October 26, 2026, we found no court order that stops Coinbase making event contracts available in Kentucky. Kentucky's attorney general sued Coinbase Financial Markets alongside Kalshi's companies on June 17, 2026, calling the sports contracts on its hub unlicensed sports wagering. Kalshi's companies moved the case to federal court with Coinbase's consent, and we could not determine whether the judge has ruled on Kentucky's request to send it back.

Has Kentucky banned Coinbase prediction markets?

As of October 26, 2026, no order we found does. Kentucky's complaint asks a court for temporary and permanent injunctions and for an order stopping what it calls Coinbase's gambling devices, its website and mobile apps. Those are requests, and in the documents we read no court has granted them.

Why is Kentucky suing Coinbase?

As of October 26, 2026, the state's claims against Coinbase Financial Markets are Counts 13 to 16 of its June 17 complaint. Kentucky alleges that Coinbase's Kalshi-sourced hub lets Kentucky residents place unlicensed sports wagers and gives the impression those wagers are lawful in Kentucky. The counts arise under the Consumer Protection Act, the Loss Recovery Act and the gambling devices statute. Those are the state's allegations, and no court has decided them.

Does Kentucky tax prediction market operators like Coinbase?

As of October 26, 2026, Section 71 of House Bill 757 imposes a 14.25% excise tax on a prediction market operator's transaction fees from January 1, 2027. The statute defines an operator in general terms and names no company, and we found no Kentucky statement on whether Coinbase Financial Markets is one. The same section says the General Assembly does not intend to legalize these activities. It taxes operators' fees, not traders.

Can I still use Coinbase prediction markets in Kentucky?

As of October 26, 2026, no order we found stops it, and nothing we read addresses accounts, deposits, withdrawals or open positions. The complaint alleges Coinbase makes sports wagering available to Kentucky residents, but that is an allegation, and we could not confirm from a primary document which contracts Coinbase offers Kentucky residents today.

Does the Kentucky case change how Coinbase trades are taxed?

As of October 26, 2026, no. The case asks whether Kentucky's consumer protection and gambling laws reach these contracts, which is not a federal tax question. The IRS has issued no guidance on event contracts, and the people we've seen file report them three common ways: as gambling under section 165(d), as capital gains on Form 8949, or under Section 1256 on Form 6781.
