IRS forms
Which IRS forms can a prediction market year land on?
It depends on how the year is reported, and there is no IRS guidance on event contracts.
The IRS has issued no guidance on how event contracts are taxed. Of the people we’ve seen file, these are the most common ways they file, and each puts the year on different forms.
| Route | IRS forms | What goes there | Guide |
|---|---|---|---|
| Standard capital | Form 8949 and Schedule D | Each closed position as a sale, one row per sale, netted into short-term and long-term totals. | Prediction market capital gains |
| Section 1256 | Form 6781, then Schedule D | The year’s net gain or loss, split 60% long-term and 40% short-term, with positions open at December 31 treated as sold at their fair market value that day. | Form 6781 for event contracts |
| Gambling | Schedule 1 for winnings; Schedule A for losses | Winnings as other income; losses only for people who itemize, up to the year’s winnings and, from tax year 2026, 90% of them under §165(d). | Are prediction markets gambling? |
Where no venue form reports your trades, the year’s result comes from the venue’s own trade history. What each export covers: Kalshi trade history and exports, Polymarket US trade history and exports, Robinhood event contract history and P&L, Novig trade history and statements.
