Is Kalshi Legal in California? The Tribal Case, Explained

No California order blocks Kalshi. Two tribes won a Ninth Circuit ruling that its sports contracts on tribal land likely break federal law. What it covers.

As of October 8, 2026, Kalshi is available in California, sports included. We found no California court order or state agency action against Kalshi. The live case is tribal: on September 16, 2026 the Ninth Circuit held that two California tribes are likely to show that Kalshi's sports contracts, when entered on their land, violate federal tribal-gaming law. No injunction has issued.

Nothing in California switches Kalshi off. No California court has ordered it to stop, and we found no lawsuit, cease-and-desist or fine from the Attorney General, the Gambling Control Commission or the Bureau of Gambling Control. That makes California unlike Washington, Nevada and Michigan, where state courts have ordered markets off.

California has not legalized sports betting. In November 2022 voters rejected Proposition 26 (sports wagering on tribal lands, 33.0% yes) and Proposition 27 (online sports wagering outside tribal lands, 17.7% yes), per the Secretary of State's statement of vote. The state constitution permits slot machines, lottery games and banking card games only on tribal lands under compacts, and bars Nevada-style casinos (art. IV, §19). Kalshi's position is that its contracts are federally regulated derivatives, not bets: it is a contract market designated by the CFTC.

California's Attorney General has taken a side in the federal fight without suing. On October 7, 2026 Rob Bonta signed an Ohio-led brief from 39 states and the District of Columbia backing New Jersey's petition at the Supreme Court. A brief is not an enforcement action, and it switches nothing off.

What did the Ninth Circuit decide in the tribal case?

Blue Lake Rancheria and the Chicken Ranch Rancheria of Me-Wuk Indians sued Kalshi, KalshiEX and two Robinhood companies in federal court in San Francisco. They argued that Kalshi's sports contracts are class III gaming that the Indian Gaming Regulatory Act (IGRA) lets only the tribes run on their land. Judge Jacqueline Scott Corley refused them a preliminary injunction, reasoning that the trades don't happen on Indian lands. A third tribe, Picayune Rancheria of the Chukchansi Indians, left the appeal by agreement.

A panel of Chief Judge Mary Murguia and Judges M. Margaret McKeown and Richard Paez reversed that in part on September 16, 2026 (opinion). It held that the tribes "are likely to succeed in their claims that Kalshi's event contracts on tribal lands violate IGRA and the Tribes' gaming ordinances" (p.9). The location test is where the customer is: Kalshi's products are "located on Indian lands" when "a user enters into the event contract from tribal territory", and a customer "can still enter an event contract on Indian lands if she purchases one while on a reservation", wherever Kalshi's servers sit (pp.24-25). The panel also held that the commodities law's grant of "exclusive" jurisdiction to the CFTC doesn't displace IGRA here.

The tribes lost one claim. They said Kalshi's advertising that "Sports Betting [Is] Legal in all 50 States on Kalshi" was false. The panel disagreed that this could be sued over, because "the legality of Kalshi's products remains unsettled" (p.38).

Does the tribal ruling block Kalshi in California?

No, and not statewide. The Ninth Circuit didn't order anything to stop. It sent the case back for the district court to weigh the remaining factors for an injunction. If one issues, the claims it rests on reach contracts entered from tribal land, not a trade placed in Los Angeles or Sacramento. As of October 8, 2026 we found no injunction on remand.

That is a different kind of limit from the state orders elsewhere in the Ninth Circuit. Nevada's order covers anyone within the state, and Washington's has Kalshi geofence the whole state. Any injunction on remand would rest on claims about contracts entered from tribal land.

The Ninth Circuit also ruled against Kalshi in Nevada's case on August 28, on whether federal law preempts Nevada's gaming law, and Kalshi has asked the full court to rehear that one. California has no state enforcement case for that ruling to apply to. Kalshi at the Supreme Court follows the petitions on the same question.

Is California passing a law on prediction markets?

Three Assembly bills named prediction markets in the 2025-26 session, and as of October 8, 2026 none has moved past its first committee:

  • AB 2617, the Protecting Kids from Online Gambling Act, would bar offering "online gambling activities or prediction market wagering to minors". Re-referred to the Governmental Organization committee on March 17, 2026.
  • AB 2446 would have the Attorney General investigate any prediction-market payout of $5,000 or more on an outcome that was a matter of national security. Re-referred to the same committee on March 24.
  • AB 1840 would add prediction market contracts to the Political Reform Act. Its hearings were canceled at the author's request.

How does California tax a Kalshi year?

The federal return comes first, as in every state. There is no IRS guidance on event contracts, and of the people we've seen file, the most common routes are standard capital gains (Form 8949 and Schedule D), Section 1256 (Form 6781, the 60/40 split and the year-end mark) and gambling (winnings on Schedule 1, losses only if you itemize).

California then taxes the year on its own return, and two of its rules change how those routes compare there:

  • No capital gains rate. The Franchise Tax Board says "All capital gains are taxed as ordinary income" (FTB). The long-term share that lowers the federal rate under the 60/40 split doesn't lower the California rate.
  • Gambling losses up to winnings. "Gambling losses are deducted from the winnings as an itemized deduction", and generally not beyond them (FTB).
