Is Kalshi legal in all 50 states?
No state has switched Kalshi off entirely. KalshiEX LLC is designated by the CFTC as a contract market. Where a state court’s order is in force, Kalshi has to block some kinds of market, sports among them, for anyone located in that state, and its other markets keep trading. Every state on this page sits in one of four groups:

Behind every case is one question: whether federal commodities law keeps state gambling law away from contracts on a federally registered exchange. Federal appeals courts have answered it in different ways, so it is unresolved, and three petitions ask the Supreme Court to decide it.

Lawsuits
What states have sued Kalshi?
As of Oct 8, 2026, Massachusetts, Nevada, Michigan, Washington State, Wisconsin, Rhode Island, Kentucky, New York and Connecticut have taken Kalshi to court. Two other things also get called suing Kalshi, and only an order in force switches anything off.
- A state takes Kalshi to court. An attorney general or gaming regulator sues in state court, as Washington, Michigan, Massachusetts and Nevada did. Every order that has switched Kalshi markets off came out of a case like these.
- Kalshi sues the state first, asking a federal court to stop regulators enforcing state gambling law against it.
- A regulator acts on its own, with a cease-and-desist letter, a proposed fine or, in Arizona, criminal charges. None of these switches anything off by itself.

What a state order means for your account.
An order stops new trades in the markets it covers. The rules that hold your cash come from Kalshi’s clearinghouse, Kalshi Klear, and make no exception by state.
- Kalshi's clearinghouse, Kalshi Klear, has been registered with the CFTC as a derivatives clearing organization since August 2024. Primary source
- Kalshi Klear's rules require money you deposit directly to be kept separate from its own money, and never mixed with it. Primary source: R7.7F, R7.9C
- SIPC doesn't cover prediction-market accounts. It excludes commodity futures. Primary source
- Kalshi Klear uses a bank sweep meant to add FDIC coverage, but Kalshi's own agreement says that coverage is not guaranteed to you. Primary source: §IV

Washington State

Location
Why does Kalshi say my location is restricted?
The orders make the block follow where you are, not only where you live.
Washington’s order had Kalshi block by IP address and residency from August 19, 2026, then through GeoComply from September 2, to stop anyone located within the state buying the covered contracts (amended order, p.13). Michigan’s preliminary injunction requires a geolocation provider licensed by the state’s gaming control board. In Nevada, Kalshi agreed in July to a GeoComply geofence covering anyone within the state.
So a location check that stops you in one of those states may be the order working, and it can stop sports trading while other markets stay open.

Whether federal law preempts state gambling law here is unresolved. Kalshi at the Supreme Court follows the petitions. A state court finding that Kalshi likely breaks state gambling law isn't a ruling on how your trades are taxed. Federal tax treatment is a question under the Internal Revenue Code, and no court or IRS guidance has settled it for event contracts.

Ingham County Circuit Court (Judge Rosemarie Aquilina) signed a preliminary injunction on September 1. It covers sports betting and similar products only, and requires a Michigan-licensed geolocation vendor, with a $500,000 fine for each day geolocation is found non-compliant.
What’s next in Michigan: Coinbase agreed on October 7 to stop new sports contracts on Kalshi's exchange for Michigan customers and close open ones by 12:00 a.m. ET on October 10; Robinhood's close-out deadline is October 9. The state case continues toward a final order.

Carson City District Court granted Nevada a preliminary injunction on April 3, 2026. On August 28 the Ninth Circuit ruled 3-0 against Kalshi on the federal question. A July 24 court order has Kalshi pay $120,000 a day, or explain under oath, if its geofence wasn't in place by August 12; in mid-August Nevada regulators told the court the deadline was missed and asked for the payments. No ruling on that request has been found.
What’s next in Nevada: Kalshi's request for the full Ninth Circuit to rehear the case. On September 25 Kalshi asked the court to hold it until the CFTC finishes revising its event-contract rule, and Nevada opposed on October 1. The state-court injunction stays in force either way.

King County Superior Court (Judge John McHale) granted a preliminary injunction on July 20 and signed the amended order on August 12. Kalshi had to geofence by IP and residency by August 19 and through GeoComply by September 2. The order says Kalshi will not stop users exiting positions they already hold, and does not stop Washington users closing their accounts and withdrawing funds. The Court of Appeals refused to pause it, and on September 16 the judge refused to reconsider.

Is Kalshi legal in Massachusetts?
A court ordered Kalshi to block markets in Massachusetts, but the order is on hold, so you can still trade there.
A court ordered sports contracts off, then paused it. You can still trade here.
Suffolk Superior Court granted Massachusetts a preliminary injunction on January 20. An Appeals Court justice stayed it in February pending appeal. The Supreme Judicial Court heard the case on May 4, hasn't ruled, and has waived its usual 130-day deadline for deciding.

Is Kalshi legal in Arizona?

Arizona's criminal case against Kalshi is blocked by a federal injunction. Nothing is switched off.
Arizona filed 20 misdemeanor counts in March. On May 5 a federal judge granted the CFTC a preliminary injunction blocking the prosecution while the case goes on. On September 14 Arizona asked the Ninth Circuit to lift that block for sports contracts, citing the court's August ruling in the Nevada case; the CFTC opposed, and the court hasn't ruled.

A federal judge refused Kalshi an injunction against Connecticut's regulators in August, and Kalshi has appealed to the Second Circuit. Connecticut's attorney general sued Kalshi in state court on August 26, 2026; Kalshi moved the case to federal court the same day, and the court has paused its deadlines until it decides whether to send the case back.

A federal court has partly blocked Illinois. Nothing is switched off.
Illinois's Gaming Board sent Kalshi a cease-and-desist in April 2025, and the CFTC sued Illinois in April 2026. On October 2, 2026 a federal judge in Chicago granted Kalshi's, Coinbase's and the CFTC's injunction requests in part, holding Illinois's sports-wagering licensing requirement and a related criminal provision likely preempted as applied to Kalshi's core sports contracts. Missouri's attorney general has sent cease-and-desist letters to Kalshi and five other prediction markets, warning that failure to comply will result in enforcement action. The release is undated.

Is Kalshi legal in Montana?

Montana's gambling regulator sent a cease-and-desist in April. On September 17, 2026 the two sides agreed to dismiss Kalshi's suit, and every state defendant, the attorney general included, agreed to bring no enforcement action against Kalshi until its request for further review of the Ninth Circuit's Nevada ruling is denied or the full court decides it. After that, the attorney general and the gambling division must give Kalshi 30 days' written notice before acting.

The Third Circuit ruled 2-1 for Kalshi on April 6. New Jersey filed a petition with the U.S. Supreme Court on September 2 (No. 26-299).

Kalshi lost its federal bid to stop New York's gaming regulator in July and has appealed to the Second Circuit. The New York attorney general sued Kalshi in state court on July 31, 2026; Kalshi moved the case to federal court the same day, and the attorney general has asked the court to send it back.

Kalshi lost its appeal against Ohio. Nothing is switched off.
A federal court refused to stop Ohio enforcing its gambling law against Kalshi, and on September 25, 2026 the Sixth Circuit upheld that refusal. It held that Kalshi hadn't shown its sports contracts are swaps and, in the alternative, that federal commodities law doesn't preempt Ohio's gambling law. ReadWrite reported on April 16, 2026 that the Ohio Casino Control Commission had proposed a $5 million fine; we haven't found the Commission's notice.

Rhode Island's attorney general sued Kalshi and Polymarket's US exchange in state court on May 21, 2026. Polymarket's exchange moved the case to federal court the next day, with Kalshi's consent, where it joined Kalshi's own suit against the state's regulators, and the CFTC joined that suit on Kalshi's side on May 28. The court heard the injunction requests on August 3 and hasn't ruled.

A federal court granted Kalshi an injunction against Tennessee in February. On September 25, 2026 the Sixth Circuit vacated it and sent the case back, in the same opinion that ruled for Ohio. Tennessee's attorney general said the decision lifts the order that had blocked the state from enforcing its laws against Kalshi. The ruling takes effect when the Sixth Circuit issues its mandate.
