Is Kalshi Legal in Texas? No State Case, No Income Tax
We found no Texas order, lawsuit or cease-and-desist against Kalshi. The Texas Senate is studying prediction markets, and Texas has no personal income tax.

As of October 8, 2026, Kalshi is available in Texas, sports included, and we found no Texas order, lawsuit or cease-and-desist against it. Texas hasn't legalized sports betting, and in March 2026 the Lieutenant Governor asked a Senate committee to study prediction markets before the legislature returns in January 2027. Texas also has no personal income tax, so for a Texas resident a Kalshi year is a federal filing only.
Is Kalshi legal in Texas?
No Texas court or agency has acted against Kalshi that we can find. We read the Attorney General's news releases from November 2025 to October 8, 2026 and found none that names Kalshi, prediction markets or event contracts, and no federal case naming Kalshi has been filed in a Texas court in the dockets we searched. Kalshi's markets, sports included, trade in Texas the way they do in most states.
Texas's betting law sits in the Penal Code, which, subject to the exceptions and defenses it lists, makes it an offense to make "a bet on the partial or final result of a game or contest" or "on the result of any political nomination, appointment, or election", and defines a bet as "an agreement to win or lose something of value solely or partially by chance" (Penal Code ch. 47, §§47.01, 47.02). No Texas court or prosecutor has applied that chapter to Kalshi as of October 8, 2026. Kalshi's position, wherever states have challenged it, is that its contracts are derivatives on a CFTC-designated contract market, regulated by federal law rather than state gambling law.
What is Texas doing about prediction markets?
As of October 8, 2026, Texas is studying prediction markets, not regulating them: no bill names them. Lieutenant Governor Dan Patrick's 2026 interim charges, released March 27, gave the Senate State Affairs Committee a charge titled "Closing Gambling Loopholes" (interim charges):
Study the sudden inundation of prediction market gambling and the exploitation of federal law to circumvent Texas gambling prohibitions by allowing users to place bets on the outcome of elections and other events. Examine the relationship between federally regulated derivative markets and state-prohibited gambling. Make recommendations to ensure the integrity of Texas elections and Texas sports.
A charge asks for a study and recommendations. It changes no law, and any bill comes after the 90th Legislature convenes on January 12, 2027, the second Tuesday of January in an odd year (Gov't Code §301.001). We haven't located the House's interim charges.
In the last session, sports betting itself didn't pass. Five joint resolutions in 2025 would have put legal sports wagering, or casinos and sports wagering, to voters: SJR 16, SJR 65, SJR 82, HJR 134 and HJR 137. Each stopped at committee referral (SJR 16 history).
Where does Texas stand in the federal fight?
Texas has no case of its own. It sits in the Fifth Circuit, which isn't among the federal appeals courts that have ruled on Kalshi; the Third Circuit ruled for Kalshi, and the Ninth and Sixth for the states (where the courts stand). When Ohio filed a brief on October 7, 2026 for 39 states and the District of Columbia backing New Jersey's Supreme Court petition, Texas was not one of them. A private group, Texans Against Gambling, filed its own brief with two others the same day (docket).
Do you pay Texas tax on a Kalshi year?
No. The Texas Constitution says "The legislature may not impose a tax on the net incomes of individuals" (art. 8, §24-a), and since November 2025 it also says the legislature "may not impose a tax on the realized or unrealized capital gains of an individual" (art. 8, §24-b) (Texas Constitution, art. 8). So a Texas resident's Kalshi year lives on the federal return alone, whichever way it is filed.
That makes the federal route the whole question. There is no IRS guidance on event contracts, and of the people we've seen file, three routes are the most common: standard capital gains on Form 8949 and Schedule D, Section 1256 on Form 6781 with its 60/40 split and year-end mark, and gambling, with winnings on Schedule 1 and losses only if you itemize. With no state return to reconcile, the federal figures under each route are the only figures.
