Is Kalshi Legal in Florida? No State Case, No Income Tax
We found no Florida order, lawsuit or cease-and-desist against Kalshi. Sports betting runs through the Seminole Tribe, and there's no state income tax.

As of October 8, 2026, Kalshi is available in Florida, sports included, and we found no Florida order, lawsuit or cease-and-desist against it. Florida's gaming regulator says legal sports wagering there runs through the Seminole Tribe under its 2021 compact, and the 2026 legislative session ended with no bill naming prediction markets. Florida has no personal income tax, so for a Florida resident a Kalshi year is a federal filing only.
Is Kalshi legal in Florida?
Nothing in Florida switches Kalshi off. We read every press release the Florida Gaming Control Commission has posted, September 2024 to September 2026, and the titles of every Attorney General release through October 8, 2026, and none names Kalshi, prediction markets or event contracts.
Florida's regulators have acted against other kinds of online gambling. In February 2025 the Commission sent cease-and-desist letters to three offshore sportsbooks, BetUS, Bovada and MyBookie (release). On August 19, 2026 Attorney General James Uthmeier sued the operators of online sweepstakes casinos, Stake and VGW's Chumba Casino, LuckyLand and Global Poker among them (release). Neither action involves Kalshi, which operates as a contract market designated by the CFTC.
Who controls sports betting in Florida?
As of October 8, 2026, the Seminole Tribe, under a compact with the state, and the voters. Since 2018 the constitution has said "Florida voters shall have the exclusive right to decide whether to authorize casino gambling" (art. X, §30). The legislature created the Florida Gaming Control Commission to regulate gaming, housed in the Attorney General's department but "not subject to control, supervision, or direction" by it (s. 16.71, F.S.).
The Commission's own reading of the 2021 compact, from its football-season statement of September 3, 2026: "Under the 2021 Gaming Compact between the State of Florida and the Seminole Tribe of Florida, sports wagering in Florida may be offered through sportsbooks operated by or in conjunction with the Seminole Tribe. … Wagers placed in Florida through other online sportsbooks are most likely illegal" (FGCC statement). A federal challenge to the compact, West Flagler Associates v. Haaland, ended when the Supreme Court declined to hear it on June 17, 2024, after the D.C. Circuit's June 30, 2023 decision (No. 23-862).
That statement speaks to sportsbooks. It doesn't name Kalshi or event contracts, and whether a contract on a federally regulated exchange counts as a wager under Florida law is the same open question being fought in other states.
Is Florida passing a law on prediction markets?
Not in 2026. A search of every 2026 bill version and amendment on the Florida Senate's site returns nothing for "prediction market", "event contract" or "Kalshi" (2026 bills). The session's sports-wagering bills died: SB 1164 in the Regulated Industries committee and SB 1580 in returning messages, both on March 13, HB 189 when it was laid on the table on March 11, and HB 591 with them. The next regular session convenes March 2, 2027 (art. III, §3).
Florida also stayed out of the Supreme Court fight. When Ohio filed a brief on October 7, 2026 for 39 states and the District of Columbia backing New Jersey's petition against Kalshi, Florida was not on it. Florida sits in the Eleventh Circuit, which isn't among the federal appeals courts that have ruled on Kalshi (where the courts stand).
Do you pay Florida tax on a Kalshi year?
No. Article VII, section 5(a) of the Florida Constitution says "No tax upon estates or inheritances or upon the income of natural persons who are residents or citizens of the state shall be levied by the state", beyond what a federal credit would allow (Florida Constitution). There is no Florida income tax return for the year's trades to land on.
So the federal return decides it. The IRS has issued no guidance on event contracts. Of the people we've seen file, most use one of three routes: standard capital gains (Form 8949, Schedule D), Section 1256 (Form 6781, where 60% of a gain or loss is long-term and open positions are marked at December 31), or gambling (winnings on Schedule 1, losses deductible only by itemizing).
