Is Kalshi legal in Rhode Island?

Last checked against court dockets and filings · Updated

As of October 25, 2026, we found no order in force stopping Kalshi in Rhode Island. On May 21 Kalshi sued three state officials and Attorney General Peter F. Neronha sued Kalshi; the cases now run together in federal court. The state calls the contracts unauthorized gambling; Kalshi says only the CFTC may regulate them. That is a licensing fight, not a tax ruling, and with no IRS guidance people file event contracts under three common routes.

Kalshi's suit

Why did Kalshi sue Rhode Island's officials?

KalshiEX LLC filed its complaint in the District of Rhode Island on May 21, 2026, as KalshiEX LLC v. Furcolo, No. 1:26-cv-00327 (p.1, p.32). It names three officials in their official capacities: Mark Furcolo, director of the Division of State Lottery; Attorney General Neronha; and Christina Tobiasz, gaming and athletics administrator at the Department of Business Regulation.

The complaint explains the timing. Kalshi says its representatives met the attorney general and his staff on May 20, 2026, that the office made clear it believed Kalshi's offerings "do not comply with Rhode Island gaming laws", and that Kalshi "would not receive any advanced notice" before an enforcement action (¶3, pp.2-3). It also quotes Furcolo telling the press that the Lottery's investigation into prediction markets is "very active" (¶4, p.3). Kalshi counts the state's gambling statutes, which it says carry felony charges and fines of up to $1,000 a day, as the threat it is suing over (¶7, p.4).

The suit has one theory, the Supremacy Clause (Count I): the Commodity Exchange Act gives the CFTC exclusive jurisdiction over Kalshi's exchange and preempts Rhode Island's gambling laws as applied to it. It asks for a declaration that eight listed Rhode Island statutes, and "any other Rhode Island law that attempts to regulate transactions traded or executed on Plaintiff's exchange", violate the Supremacy Clause as applied to Kalshi, and for temporary, preliminary and permanent injunctions against enforcing them (p.31).

The state's suit

What is Rhode Island's own case against Kalshi?

The state's suit is The State of Rhode Island v. KalshiEX LLC and QCX LLC d/b/a Polymarket US, filed in Providence County Superior Court as No. PC-2026-2753 and dated May 21, 2026. We have not read the complaint. The notice that removed it to federal court, filed by Polymarket US on May 22, says the state treats the contracts as subject to the Rhode Island Constitution and as "unauthorized gambling" under state law (¶17, p.7). Kalshi did not remove the case itself: the notice records that "KalshiEX LLC consents to this removal" (p.1). It became D.R.I. No. 1:26-cv-00333.

What the state says, as reported in that notice, is that sports wagering and online casino gaming in Rhode Island run through the State Lottery, and that neither company holds the license or contract the law requires. Polymarket in Rhode Island sets out the claims as the notice frames them for Polymarket US.

Consolidation

How were the two Rhode Island cases joined, and where is the CFTC?

On June 5, 2026, every party, the attorney general included, signed a consent motion asking the court to consolidate the state's case with Kalshi's and make Kalshi's the lead case. The motion adds that "the State of Rhode Island will not seek to remand" its own case to state court (ECF 26, p.1). That leaves the dispute in one federal courtroom, unlike Kentucky or Connecticut, where the state is fighting to get its case back.

The United States and the CFTC are on Kalshi's side. They appear on the June 5 caption as proposed plaintiff-intervenors, and on a July 28 filing in the consolidated case as plaintiff-intervenors (ECF 41, p.1). A Kalshi brief in another state cites their intervenor complaint as Dkt. 37, dated June 26, 2026; we have not read it.

The preliminary-injunction motions in the joined case are pending, and we found no ruling. A local report says they were argued on August 3 and taken under advisement; we did not confirm the hearing from the docket. An appeal from the District of Rhode Island goes to the First Circuit, which has not ruled on Kalshi's contracts in any case we found.

The circuits that have ruled split. The Third Circuit sided with Kalshi in New Jersey on April 6, 2026; the Ninth Circuit ruled for Nevada on August 28; and the Sixth Circuit ruled for Ohio and Tennessee on September 25. Each is a preliminary-stage ruling on federal commodities law, and the preemption question is now in petitions at the Supreme Court, which Kalshi at the Supreme Court follows. Both sides of the gambling question are set out in is Kalshi gambling?

Can I withdraw money or keep trading Kalshi in Rhode Island?

No order or filing we found in either Rhode Island case addresses withdrawals, deposits or open positions on Kalshi, and no court has granted an injunction against Kalshi or the state. Because we have not read the state complaint, we do not describe what it asks a court to do about Rhode Island customers' funds.

Tax

Does the Rhode Island case change how you report Kalshi trades for tax?

Rhode Island's position is that the contracts are gambling the Lottery alone may offer; Kalshi's is that the Commodity Exchange Act puts them under the CFTC and out of the state's reach. Both are arguments about who regulates the exchange. Neither side's filings address federal income tax, and the IRS has offered no guidance on event contracts.

Of the people we've seen file, three ways are the most common: reporting it as gambling income, Form 8949 capital gains, and Section 1256 on Form 6781. How Realize rebuilds a Kalshi year from its fills under each is in how to file Kalshi taxes, and every other state is on the Kalshi legal page.

Questions7 questions

Questions about Kalshi in Rhode Island.

Short answers, as of Oct 25, 2026.

Is Kalshi legal in Rhode Island?

As of October 25, 2026, we found no court order that stops Kalshi operating in Rhode Island. Kalshi sued the state's lottery director, attorney general and gaming administrator in federal court on May 21, 2026, and the attorney general sued Kalshi and Polymarket US the same day. The two cases were joined in federal court in Providence, and we found no ruling on the requests for a preliminary injunction.

Did Rhode Island ban Kalshi?

As of October 25, 2026, no order we found does. Rhode Island has sued and says the contracts are unauthorized gambling under its law, but a lawsuit is a request. No court has granted an injunction against Kalshi in the state.

Why did Kalshi sue Rhode Island?

Kalshi's complaint says that at a May 20, 2026 meeting the attorney general's office made clear it viewed Kalshi's contracts as breaking Rhode Island gaming law and would give no assurance against enforcement. Kalshi asks the court to declare the state's gambling statutes preempted by the Commodity Exchange Act as applied to its exchange, and to bar the three officials from enforcing them.

Is the CFTC involved in the Rhode Island case?

Yes. The United States and the CFTC appear as plaintiff-intervenors on Kalshi's side of the joined case, according to its July 28, 2026 caption. Their position is that federal law gives the CFTC exclusive jurisdiction over contracts traded on a designated exchange.

Can I withdraw my money from Kalshi in Rhode Island?

No order or filing we found in the Rhode Island cases addresses withdrawals, deposits or open positions on Kalshi. We have not read the state complaint itself, so we do not describe what it asks a court to do with customer funds.

Does the Rhode Island case change how you report Kalshi trades for tax?

It doesn't settle it. Rhode Island says Kalshi's contracts are gambling that only its Lottery may offer, and Kalshi says federal commodities law takes that question away from the state. That is a licensing dispute, not a tax ruling, and the IRS has offered no guidance on event contracts. Of the people we've seen file, the three most common ways are gambling income under section 165(d), standard capital gains on Form 8949, and Section 1256 on Form 6781.
